Welcome to Acua.app (“Acua”, “we”, “our”, or “us”), operated by Hawkrel Inc., a company incorporated in Switzerland.

These Terms of Use (“Terms”) govern your access to and use of the Acua mobile application, website, and related services (collectively, the “Services”).

By downloading, accessing, or using Acua, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, please do not use our Services.

1. Eligibility and Account

  • You must be at least 16 years old (or the legal age of digital consent in your country) to use Acua.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree that all information provided during registration is accurate and up to date.
  • We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

2. Description of Service

Acua provides a privacy-first participation platform where users can voluntarily share anonymized insights or activity data to earn reward points (“Acua Points”) and build a verified digital profile (“Digital Passport”).

  • Acua Points are not cash or digital currency.
  • Points hold no intrinsic monetary value and are not transferable, tradable, or exchangeable for cash within the app.
  • Off-app redemption or voucher programs may be made available at Acua’s discretion and subject to eligibility and regional availability.
  • Participation in any data or rewards program is voluntary and governed by consent provided within the app.

3. User Responsibilities

You agree to:

  • Use the Services only for lawful purposes and in accordance with these Terms.
  • Not attempt to reverse engineer, copy, or disrupt any part of the platform.
  • Not upload, transmit, or share any content that is illegal, harmful, or infringes on third-party rights.
  • Respect other users and refrain from abusive, misleading, or fraudulent behavior.

Failure to comply may result in suspension or permanent removal from the platform.

4. Rewards & Redemption

  • Rewards are granted based on participation, data contributions, or engagement with specific programs.
  • Acua Points have no guaranteed exchange rate and may expire or change as the platform evolves.
  • Any redemption (e.g., vouchers or benefits) is managed through Acua’s website or authorized partners, subject to verification and local availability.
  • Acua reserves the right to modify, suspend, or discontinue any reward mechanism at any time without prior notice.

5. Data Collection and Privacy

Your use of Acua is also governed by our Privacy Policy, which explains what information we collect, how it’s used, and your rights.

By using Acua, you consent to the collection and processing of your data as outlined in that policy.

We do not sell your personal information and we prioritize privacy, consent, and transparency in every program.

6. Intellectual Property

All content, trademarks, logos, and technology within the Services are owned or licensed by Hawkrel Inc. and are protected by applicable copyright and intellectual property laws.

You may not copy, modify, or redistribute any part of the Services without written permission.

You are granted a limited, non-exclusive, revocable license to use the app for personal, non-commercial purposes.

7. Termination of Use

We may suspend or terminate your account at any time if:

  • You breach these Terms or any applicable law;
  • We are required to do so by regulatory or security reasons; or
  • The Service is discontinued.

Upon termination, you will lose access to your account and any accumulated points.

8. Disclaimers

  • The Services are provided “as is” and “as available”, without warranties of any kind.
  • We do not guarantee that participation will result in rewards or that all features will be available in every region.
  • Hawkrel Inc. is not liable for losses arising from technical failures, data errors, or interruptions in service.

Use of the platform is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Hawkrel Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use or inability to use the Services.
  • Our total liability in any claim shall not exceed the amount (if any) you have paid to Acua in the preceding twelve months.

10. Indemnification

You agree to indemnify and hold harmless Hawkrel Inc., its affiliates, and employees from any claims, damages, or expenses arising from:

  • Your use or misuse of the Services,
  • Violation of these Terms, or
  • Infringement of any third-party rights.

11. Modifications to the Service

We reserve the right to:

  • Modify or discontinue any part of Acua without notice;
  • Update or revise these Terms as needed.

Changes take effect upon posting on our website. Continued use after changes means you accept the new Terms.

12. Governing Law & Jurisdiction

These Terms are governed by and construed under the laws of Switzerland, without regard to conflict-of-law principles.

Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Zurich, Switzerland.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hawkrel Inc. regarding your use of Acua.

If any part of these Terms is found invalid, the remaining provisions will continue to apply.
